In a significant verdict reflecting the ongoing struggles for LGBTQ+ rights in Kenya, photographer Jacktone Odhiambo has been sentenced to 50 years in prison for the gruesome murder of his housemate and LGBTQ+ activist, Edwin Kiprotich Kipruto, commonly known as Edwin Chiloba. The sentencing was upheld by Judge Reuben Nyakundi, who condemned the "diabolical manner" of the crime that took place in early January 2023.
Chiloba, a 25-year-old fashion designer and vocal advocate for LGBTQ+ rights, was found brutally killed, with evidence indicating he had been smothered and his body placed in a metal box discarded by the roadside in Eldoret. The murder case sparked widespread outrage and fear within the Kenyan LGBTQ+ community, highlighting the ongoing violence faced by members of the community.
Judge Nyakundi pointed out that Odhiambo's lack of remorse during the trial contributed to the severity of the sentence. After the ruling, Odhiambo exhibited a dramatic response, collapsing and weeping in the courtroom. "I have considered all factors and found that Odhiambo was a vengeful person who committed the killing of his close friend," stated Justice Nyakundi.
The prosecution presented compelling evidence, including testimonies from 23 witnesses and DNA evidence linking Odhiambo to the crime scene. Details revealed that Chiloba's body had socks stuffed into his mouth and a piece of denim tied around his face. A post-mortem examination confirmed that Chiloba died from asphyxiation due to smothering. In a further disturbing revelation, the evidence suggested that the suspect had sexually assaulted Chiloba prior to his death.
The trial also raised complex questions regarding the nature of the relationship between the two men, with some eyewitness reports suggesting they could have been romantically involved. However, the court did not determine a motive for the heinous act, leaving many questions unanswered within the community.
This watershed moment in the judicial landscape of Kenya comes as activists continue to fight for the rights and safety of LGBTQ+ individuals in the country, amidst speculation about potential anti-LGBTQ+ legislation. The outcome of this case underscores the necessity for ongoing advocacy and reform in addressing violence against marginalized communities within Kenya and beyond.
