GREENBELT, Md. — In a landmark decision, U.S. District Judge Paula Xinis has ordered the immediate release of Kilmar Abrego Garcia from immigration detention as he continues his legal fight against deportation to El Salvador. Abrego Garcia's case has garnered attention as he seeks to defend himself against what he describes as punitive deportation attempts following a wrongful removal he experienced in March.


Judge Xinis stated, Since Abrego Garcia’s return from wrongful detention in El Salvador, he has been re-detained, again without lawful authority, affirming that he must be let go from Immigration and Customs Enforcement (ICE) custody.


Abrego Garcia, originally from El Salvador, had previously been granted a rejection of deportation orders due to credible threats against him from gang members in his home country. His ongoing legal plight reflects broader issues surrounding the U.S. immigration system, particularly during the controversial Trump administration, which had implemented stringent immigration enforcement policies.


Abrego Garcia has an American wife and child and has lived in Maryland for several years. After being wrongfully sent back to El Salvador earlier this year, which sparked significant outcry from immigration advocates and citizens alike, he was eventually permitted to return to the United States under court order. Currently, ICE is attempting to deport him to a series of third countries as part of its enforcement actions.


In addition to his immigration woes, Abrego Garcia is also facing criminal charges in Tennessee related to allegations of human smuggling, which he vehemently denies, asserting that the charges are part of a vindictive prosecution aimed at punishing him further. As part of his legal strategy, he is petitioning to reopen his immigration case to seek asylum in the U.S.
