In an unprecedented move, Ghana's Chief Justice Gertrude Torkornoo has been suspended, igniting fierce backlash from the opposition and concerns about the integrity of the country's judiciary.



Ghana's political landscape has been shaken to its core with the suspension of Chief Justice Gertrude Torkornoo, the first of its kind in the nation's history. Opposition parliamentarians have criticized President John Mahama for potentially undermining judicial independence and attempting to "pack the courts" with judges aligned with the ruling party, the National Democratic Congress (NDC).

The suspension was announced following three undisclosed petitions that allege misconduct on the part of Torkornoo. This lack of transparency has raised questions about the motivations behind her removal. As the nation grapples with this tumultuous event, the President's supporters argue that it was necessary to clean up the judiciary, whereas opposition voices characterize it as a blatant misuse of power.

In the wake of the suspension, two additional petitions have surfaced, further complicating the situation. Former Attorney General Godfred Yeboah Dame called the suspension a "charade" and a significant assault on judicial integrity, stressing that the legality of the President's actions should be questioned.

The opposition has noted the procedural errors in the suspension; specifically, there were allegations that the president did not provide Torkornoo with copies of the petitions prior to her suspension, a legal requirement. This procedural misstep has intensified criticism, as opposition politicians argue it violates due process.

Despite the controversies, some citizens have defended the president, claiming he aims to rectify grievances with the judiciary. Supporters like Dr. Tony Aidoo emphasize the need for accountability within the courts, suggesting that Torkornoo's presence inhibits judicial reform.

Historically, Ghana's chief justices have either retired or completed their terms; Torkornoo, serving as the third female chief justice, was nominated by former President Akufo-Addo in 2023. Her tenure had narrowly escaped removal earlier in the year, attributed to perceived deficiencies in a previous petition for her dismissal.

In response to the current crisis, authorities have established a five-member committee to investigate the allegations against Torkornoo. The outcome of this investigation and the subsequent reactions will be critical in determining the future of Ghana's judiciary and the balance of power within its government.
