In brief

Australia has taken significant steps in safeguarding its youth with a new law that bans children under the age of 16 from using social media platforms like TikTok, Instagram, and others. This unprecedented measure draws attention to the ongoing fight against bullying, online harm, and mental health challenges faced by minors today.

On Wednesday, the legislation easily passed through the lower house of Parliament, and it received bipartisan backing in the Senate the following day. Prime Minister Anthony Albanese emphasized the importance of this initiative, asserting that it positions Australia at the forefront of global efforts to protect children's mental health from the adverse effects of social media. Under the new law, social media companies must take "reasonable steps" to ensure users are of appropriate age. Non-compliance can lead to hefty fines, reaching up to 49.5 million Australian dollars (approximately $32 million) for significant breaches of these age requirements.Encouragingly, neither minors nor their guardians will face penalties for violations of this new law. While some critics question whether children might find loopholes to bypass these restrictions, Albanese stresses that the law aims to hold social media corporations accountable for ensuring their platforms are safe spaces. Similar to existing regulations for alcohol and tobacco, a new classification of "age-restricted social media platforms" will be created, accessible exclusively to individuals aged 16 and older. However, questions remain on how these age restrictions will be implemented effectively, as enforcing digital age verification presents a considerable challenge. By preemptively addressing the potential pitfalls of social media engagement, Australia is making a concerted effort to foster a safer online environment for its younger population.
