Eight days after the deportation of eight migrants to South Sudan, their situation remains shrouded in uncertainty. The men, labeled “the worst of the worst” by the Trump administration, were sent back following a lengthy legal battle, but now there is no clear indication of their current status or wellbeing. Since their arrival on July 4, neither the South Sudan government nor the U.S. has provided information about their whereabouts, leaving their family members in distress.

The recent decision by the Supreme Court approving such deportations has emboldened U.S. Immigration and Customs Enforcement (ICE) to issue new guidelines that may facilitate the practice of sending detainees to third countries. This move is particularly concerning for advocates and immigration experts, who fear it could normalize practices that lead to potential human rights violations. According to the updated rules, if a country can provide “credible diplomatic assurances” that deportees will not face torture or persecution, the deportation process can proceed without delay.

Advocates like Trina Realmuto argue that the expedited process, which could see deportations occur within six hours if no objections are raised, instills fear among migrants and leaves families in an "untenable position." The lack of transparency regarding the conditions under which deportees are sent raises significant ethical concerns, as many dissenting voices warn about the implications of enforced disappearances.

As this new chapter in U.S. immigration enforcement unfolds, both humanitarian groups and legal analysts are bracing for the potential repercussions of what appears to be an increasing reliance on third-country deportations.
